DVD Wills

The South Australian Supreme Court has decided recently that a DVD recording of a Will could be accepted as a formal Will. See here.

The Supreme Court’s acceptance of this particular Will in DVD form is a new development that confirms the expansion of the more traditional definition of what is a “document”, however most people’s personal circumstances make the proper, written drafting of Wills more desirable.  In this particular DVD Will case the Supreme Court took a pragmatic approach to ensuring the testator’s wishes were carried out.

We do not recommend that anyone intending to create a Will do so via DVD, as this case was decided on its facts, and the Supreme Court is unlikely to decide that every case of a Will being created via DVD is valid.
