Section 501 (6) and (7) of the Migration Act have led the Department of Home Affairs to look at the cumulative effect of any criminal offences.

Even if you serve no immediate time in prison, the Department sees any conviction totalling more than 12 months as a substantial criminal record. The Department also views suspended imprisonment the same as immediate imprisonment.
